Technically true, has there ever been a verified report of a claim being denied, no. As stated before it's really hard for manufactures to prove a mod like an ECU tune actually caused the engine or transmission issue. They can't just deny a warranty claim just because the tune is there...

Apparently the is one Reddit post claiming a warranty claim was declined due to a tune, never documented or verified. OTT has been installed in 100's of thousands of vehicles so if this was a thing there would be more than one random Reddit post.
